What’s Actually Been Tried

Ostrom specified Polycentricity, and it has teeth. Elinor Ostrom’s Governing the Commons (1990) gives eight concrete design principles for durable commons institutions: clearly defined boundaries, rules matched to local conditions, participatory rule-modification, monitoring by accountable monitors, graduated sanctions, cheap conflict-resolution mechanisms, minimal recognition of self-organization rights by higher authorities, and nested enterprises for larger commons. Several essays gesture at “subsidiarity” as a slogan; Ostrom’s work is the empirical case that it works for irrigation systems, fisheries, and forests, not (yet) for planetary-scale coordination. Nobody has run this at civilizational scale, and Ostrom herself was explicit that global commons (atmosphere, oceans) are a much harder case than local ones because monitoring and graduated sanctions get exponentially costlier as the group size and diversity grow.

Subsidiarity as actually practiced (EU) is far messier than the essays imply. The EU’s Article 5 TEU subsidiarity test: “can this be sufficiently achieved by member states, or does it need Union-level action for reasons of scale?” – sounds clean. In practice it’s contested at every application: the European Parliament’s own working documents describe a chronic fight over who gets to judge whether the test is met, and scholars (Alesina, Alberto/CEPR’s “Making Sense of Subsidiarity”) conclude it remains “an incomplete guide” absent detailed centralization-vs-decentralization arguments for each specific function. The lesson for a COS design: subsidiarity is not a rule that resolves disputes, it’s a forum in which disputes about scale get argued. You still need a court or equivalent to adjudicate it, and that court itself becomes a locus of power.

A working example of “truth-seeking beats voting” already exists at national scale — and it’s more modest than the essays’ epistemic-ecosystem fantasies. Taiwan’s vTaiwan/Pol.is process (used in ~30+ cases including the 2015 Uber dispute) doesn’t crowdsource “Truth.” It uses machine-learning clustering to show people the shape of disagreement, removes the reply button so trolling stops paying off, and only proceeds to legislation once visible consensus clusters emerge. Its real innovation isn’t AI-adjudicated truth, it’s removing the incentive structure that rewards tribal signaling (no reply-button, statement-voting instead of debate). That is a narrower, more falsifiable claim than “truth-seeking = an auditable process where claims compete against evidence” — and it’s the one that’s actually been reused across ~30 policy fights. It also required something none of the essays mention: a legitimizing shock (the 2014 Sunflower Movement) that made the civic-hacker community a trusted partner of government. Deliberative infrastructure didn’t get adopted because it was well-designed; it got adopted because a legitimacy crisis created the political opening.

Futarchy and quadratic voting are real mechanism-design proposals, and their known failure modes belong in any honest COS spec. Robin Hanson’s futarchy (“vote on values, bet on beliefs”) and Glen Weyl’s quadratic voting are cited approvingly across several essays as governance upgrades. Both are legitimate research programs (Weyl/Lalley’s QV paper is peer-reviewed welfare-economics; futarchy has 20+ years of Hanson’s own “thirty design issues” self-critique). But both have well-known failure modes the essays skip: futarchy is only as good as the welfare metric you bet against (Goodhart’s Law bites immediately. Optimize for measured GDP+ and you get manipulation of the measurement, not the outcome); it requires liquid, manipulation-resistant markets, which don’t exist for most civilizational-scale questions; and it can be gamed by a well-funded actor buying the “true” price. Quadratic voting is vulnerable to collusion and Sybil attack unless paired with a strong proof-of-personhood system, which brings us to the next problem.

Proof-of-personhood, the essays’ favorite privacy/identity fix, is currently failing in the real world. Several essays wave at “cryptographic identity,” “zero-knowledge proof of personhood,” “decentralized identity” as a solved architectural layer. It isn’t. Worldcoin/World ID is the most heavily funded real attempt (Sam Altman-backed, biometric iris-scan + zero-knowledge proofs, explicitly pitched as global proof-of-humanity infrastructure), and it’s been banned or restricted in Spain and several other jurisdictions, criticized by Forrester and privacy researchers for exactly the reason the essays worry about (a single company/foundation becoming the de facto global identity gatekeeper is itself a concentration-of-power problem, ZK-proofs notwithstanding), and it still can’t solve the Sybil-resistance problem without some biometric or trusted-hardware chokepoint that reintroduces centralization. India’s Aadhaar (1.3B+ enrolled, the most successful real-world digital-identity layer in existence, underpinning UPI’s ~70B+ monthly transactions) proves population-scale digital identity infrastructure can work as a public good, but it also draws continuous criticism in India for exclusion of the undocumented, mandatory-linkage creep, and biometric-database centralization risk. The honest state of the art: nobody has actually solved “prove you’re a unique human without creating a centralized surveillance chokepoint or a private gatekeeper.” Any COS design that treats this as solved is skipping the hardest unsolved problem in the entire stack.

Someone already built a literal cybernetic “civilizational OS” and it died in a day, for a reason every essay omits. Stafford Beer’s Project Cybersyn (Chile, 1971–73) is the closest historical precedent to several essays’ “kernel/VSM/control room” language — a real-time telex network feeding factory data into a central operations room, explicitly modeled on Beer’s Viable System Model (itself modeled on the nervous system, the same “kernel → nested subsystems” architecture several essays independently reinvented). It reportedly helped route trucks around a 1972 strike. Then Pinochet’s coup happened on September 11, 1973, and the control room was destroyed within days. The lesson isn’t about the technology. it’s that a civilizational OS has no existence independent of the political coalition that sustains it. Every essay treats “constitutional constraints the AI cannot violate” as an engineering property. Cybersyn shows constitutional constraints are a political property: they hold only as long as whoever controls the tanks respects them. No cryptographic kernel, immutable constitution, or distributed kill-switch survives a determined military coup or a determined majority that decides the constraint doesn’t apply to them. This is the single biggest shortcoming: design as if legitimacy is an engineering problem when it’s a coalition-maintenance problem.

Planetary boundaries are not a design choice. Six of nine are already breached. Rockström/Steffen’s planetary boundaries framework (Science Advances, 2023) shows humanity has already crossed six of nine safe-operating-space boundaries (climate, biodiversity integrity, land-use change, biogeochemical flows, novel entities, freshwater change). Kate Raworth’s Doughnut Economics operationalizes this as a floor-and-ceiling model and has been adopted, imperfectly, by Amsterdam since 2020 – real-world implementation research (2025-26 papers) finds it works well as a communicative compass for policymakers but struggles as a binding constraint mechanism, because cities can adopt the visual framework without adopting the enforcement teeth. The essays are right that ecological limits must be architectural rather than optimized-around, but the actual implementation record shows the gap between “adopt the framework rhetorically” and “make it a hard interrupt” is where most of these efforts currently stall.

AI constitutionalism is being built right now, badly. The “AI cannot violate constitutional constraints” layer several essays want already has a real 2024-26 institutional landscape: NIST’s AI Risk Management Framework, frontier labs’ “Responsible Scaling Policies” (Anthropic, others), the UN’s new Global Dialogue on AI Governance and Independent International Scientific Panel on AI (Sept 2025), and — critically — a 2025 independent scorecard of 12 frontier AI safety frameworks found a median compliance score of only ~18-20% against risk-management criteria borrowed from aviation and nuclear industries, with the biggest gap in governance (external accountability), not risk identification. In other words: the “AI constitutional law” layer everyone wants is currently mostly self-graded homework by the companies it’s supposed to constrain. That’s the actual starting condition any COS design has to work from, not a solved layer to assume.

The whole genre of “here is the optimal civilizational blueprint” essay has an established, sharp critique — including of itself. Longtermism/effective-altruism-adjacent thinking (which produced much of the intellectual scaffolding these essays borrow from — existential risk, “AI constitutional law,” global coordination bodies) has a serious academic and journalistic critique (Torres in Aeon, Häggström, Bramble) converging on one point: small, well-resourced ideological communities producing detailed blueprints for how all of humanity should be governed is itself a power-concentration risk, regardless of the blueprint’s content, because it substitutes the epistemic authority of the blueprint-writers for actual democratic contestation. James C. Scott’s Seeing Like a State (1998) is the deeper version of this critique, aimed at the planning impulse itself: every disaster he documents (Soviet collectivization, Tanzanian villagization, Brasília, Le Corbusier’s cities) shares four features — administrative legibility-seeking, high-modernist ideology, an authoritarian implementer, and a prostrate civil society unable to resist. A document titled “the ideal civilizational operating system” is, structurally, exactly the artifact Scott warns about — an attempt to make civilization legible and administrable from a God’s-eye view. The saving grace, if there is one, is that these particular essays (unlike Le Corbusier or Soviet planners) explicitly build in anti-legibility principles: privacy-by-architecture, pluralism-as-terminal-value, subsidiarity, reversibility thresholds. Whether that’s enough to escape Scott’s critique, or just a more sophisticated version of the same hubris, is genuinely unresolved — and worth sitting with rather than resolving too quickly.


1. Legitimacy is not a layer you architect once — it’s a resource you have to keep re-earning, and no essay models its depletion.
Every essay treats “constitutional constraint on the AI/on power” as something you specify once (in a document, a smart contract, a kernel) and it holds. Cybersyn shows legitimacy is dynamic and can vanish in a weekend. A more honest COS design would treat legitimacy the way engineers treat a depleting battery: something that’s consumed by every unpopular-but-correct decision, replenished by transparency and track record, and that has to be monitored with the same seriousness as the ecological or epistemic layers. Concretely: a COS needs a legitimacy telemetry system — tracking compliance rates, exit/dissent rates, elite defection, and institutional-trust surveys as first-class signals feeding back into governance the same way carbon budgets feed back into the ecological layer. When legitimacy telemetry crosses a threshold, the correct response isn’t “the AI enforces the constitution harder” — it’s “the system autonomously widens participation and slows down,” because Cybersyn-style history says that’s the only thing that has ever actually prevented collapse.

2. The bootstrapping problem is harder than the design problem, and none of the eight essays touch it.
You cannot deploy a civilizational OS onto 8 billion people running on incompatible legacy systems (nation-states, legal traditions, currencies) the way you deploy a new OS onto a fleet of machines. Every real-world example that partially worked — Ostrom’s commons, Taiwan’s Pol.is, India Stack — succeeded by being narrow, optional, and incremental: a single resource (irrigation water), a single dispute (Uber), a single utility (identity/payments), adopted because it solved an acute local problem, not because it was pitched as a civilizational blueprint. The actual design principle this suggests, and that I’d add as the master meta-principle missing from all eight essays:

No component of a civilizational OS should be designed at civilizational scale. Every layer should be validated as a boring, narrow, optional, locally-adoptable module first — solving one acute problem for one willing community — before anyone entertains stitching it into a “kernel.” If a layer can’t be shown working for one city, one commons, or one dispute, it has no business being specified for the planet.

This inverts the genre. Instead of designing top-down (“kernel → constitutional layer → economic layer → local nodes”), the actual historical record says it has to be bottom-up: prove the Pol.is instance, prove the Aadhaar-equivalent, prove the Ostrom-style commons regime, and only then ask what minimal connective tissue lets those modules interoperate. A COS is closer to an ecosystem of interoperable standards (like TCP/IP, or the actual India Stack “open API” philosophy) than to an operating system with a kernel someone gets to write.

3. Reversibility-weighted authority collides with the actual shape of existential risk, and the essays paper over the collision.
Several essays propose “the more irreversible, the higher the authorization threshold” as a clean principle. But the two biggest irreversibility risks on the table right now — runaway AI capability gain and climate tipping points — are exactly the cases where the correct action must be taken before consensus-building finishes, because the decision window is narrower than the deliberation window. A pure reversibility-threshold model would freeze on the cases that matter most. What’s actually needed is a second axis orthogonal to reversibility: urgency, and an explicit, pre-agreed answer for the quadrant where irreversibility and urgency are both high (which the essays never name). The honest answer, visible in how actual institutions handle this today (central bank emergency lending authority, WHO PHEIC declarations, nuclear launch protocols) is: pre-authorize narrow, specific emergency powers in advance, bound them with mandatory sunset and after-the-fact review, and accept that the “extraordinary authorization” body has to be smaller and faster than the deliberative body — which means it is, by construction, a concentration of power that the system has to actively watch. No essay names this trade-off explicitly; they all wave at “reversibility principle” as if it dissolves the tension between speed and legitimacy. It doesn’t. You have to choose, in advance, who gets to move fast, and then spend permanent institutional energy watching that they don’t abuse it.

4. Nobody addresses what happens when the epistemic layer and the democratic layer disagree — which is the normal case, not the edge case.
The essays love “epistemic ecosystem, competing evidence, adversarial AIs” and “deliberative democracy, citizens’ assemblies” as if they naturally converge. In practice — climate policy, vaccine mandates, GMOs, nuclear power, trade — the best-evidenced position and the majority-preferred position diverge constantly, and diverge along predictable partisan and cultural lines, not randomly. A COS spec has to say, explicitly, what happens when the truth-seeking layer and the deliberation layer output different answers, because “the citizens deliberate with access to the evidence” doesn’t resolve value disagreements that are downstream of values, not facts (should we prioritize this generation’s growth or the next generation’s climate stability — futarchy can price the belief about outcomes, it cannot price the value choice between them, which is exactly Hanson’s own “vote on values, bet on beliefs” split, and it’s the one place all eight essays’ architecture diagrams quietly collapse epistemics and ethics into one box).

5. A concrete addition: institutional memory should be built as a git-like, forkable, cryptographically-versioned decision log — with the DAO-hack failure mode built into the design, not ignored.
Several essays gesture at “civilization should have a memory” or “sunset clauses and version control.” The closest real infrastructure for this — DAOs and on-chain governance — already exists and has already failed in instructive ways (The DAO hack, 2016, forced an entire blockchain to hard-fork specifically because “immutable, code-is-law governance” turned out to have no answer for “what happens when the code has a bug that lets someone steal everything”). The lesson: an institutional-memory/decision-log layer is valuable (predictions attached to policies, outcomes checked against them later, precedent search across “have we tried this before”), but it must not be conflated with “therefore the rules are self-enforcing and tamper-proof.” Somewhere, some human institution retains the power to override the log when it’s wrong — and that overriding power is exactly the thing that needs the heaviest constitutional scrutiny, because it’s a backdoor by construction.

The system’s job is not to know what humanity should do. It’s to stay boring, narrow, forkable, and legitimate long enough that humanity keeps being able to decide for itself — and the biggest risk to that job is the temptation, visible in every one of these essays including this one, to write the whole blueprint at civilizational scale before any piece of it has been proven at the scale of one city, one commons, or one dispute.
